End User Licence Agreement - Terms and Conditions

Thank you for expressing an interest in booking one or more self storage units situated within a property managed by the Pocket Storage group.

Please note that these terms and conditions (referred to as the "Terms and Conditions") will apply if You decide to proceed with Your booking. A legally binding contract (referred to as the "Contract") will come into force between You, the user or users named in the booking details (referred to as "You" or "Your") and the owner of the property  (referred to as the "Owner") if You click that You accept and pay the charges outlined in the booking details.


If You require the contact details of the Owner for any reason in connection with Your Contract, You may request this information from Pocket Storage by contacting Pocket Storage via email at hello@pocket.storage or through the Pocket Storage App.


As stated on the Pocket Storage website, You must ensure that You have insurance in place to protect Yourself against loss or damage to any goods or property You decide to store within the Unit (as defined below at Clause 3 a).


If You have selected "Goods Protection" as part of your booking process, please note that the level of protection selected will, if You choose to proceed, be provided under a goods protection policy known as StoreProtect and that policy will be subject to the additional terms set out in the addendum included at the end of this document ("StoreProtect Addendum"). Please keep in mind that Pocket Storage is neither a financial nor an insurance advisor so You need to satisfy Yourself as to the suitability of that policy and You may wish to obtain independent advice to support You with that.

If You enter into a StoreProtect policy, in the event of any conflict between the clauses contained in this document and the clauses contained in the StoreProtect Addendum, the clauses within the StoreProtect Addendum will prevail.

You should read these Terms and Conditions carefully paying particular attention to Clauses 2c (fees that may apply if you fail to empty, clean and/or repair a Unit when your Contract ends), 2d (fees that may be due when yielding-up the Unit which may include debt collection fees and/or sale goods left behind), 2e (rights to sell abandoned goods), 3j (rights to remove and charge for refuse removal), 3k(cost for damage related to removal of or damage to trolleys), 3l (responsibility for damage and/or repair costs), 4b (request to change Unit size), 6c (repair and/or cleaning that might become due and 9 (liability limitations and exclusions). These Clauses have been specifically highlighted for Your attention because they contain provisions that may affect Your rights, obligations, or liabilities under this Contract.


1. COMMENCEMENT

Commencement

  1. Your Contract will come into force on the date that You click to accept the Terms and Conditions and pay the initial weekly or monthly (as applicable) charges outlined in the booking details on the Pocket Storage website or the Pocket Storage App (referred to below as the “Contract Start Date”).

  2. On or soon after the Contract Start Date You will receive an email which confirms Your booking details and contains a copy of these Terms and Conditions.


2. CONTRACT PERIOD AND YOUR RIGHTS TO BRING THE CONTRACT TO AN END


  1. Subject to Clause 2.b immediately below, Your Contract will continue until the end of the week or month (depending on which rental duration You selected during the booking process) that:

    1. You give 24 hours written notice to Pocket Storage of Your desire to end the Contract; or

    2. Pocket Storage (on behalf of the Owner) or the Owner directly gives You 24 hours written notice to end the Contract; or

    3. Pocket Storage (on behalf of the Owner) or the Owner gives You a written notice because:

      1. You have not paid the fees due in accordance with Clause 6;

      2. You have not set up a Direct Debit on or before the date of the Contract Start Date;

      3. You cancel a Direct Debit during the Term and following written notification by Pocket Storage (on behalf of the Owner) or the Owner ("Direct Debit Notice") You fail to reinstate the Direct Debit within a period of 7 days from the date of the Direct Debit Notice;

      4. You do not provide Your ID documentation required by the Owner before the Contract Start Date and at any point during the Term where reasonably required by the Owner;

      5. You have not selected "Goods Protection", You have not entered into a StoreProtect policy during Your booking process and You have not provided evidence of having sufficient, independently arranged, insurance in place (such insurance to be equivalent to the greater of (i) the Maximum Replacement Value (as defined in the StoreProtect addendum below) or (ii) £2,500) prior to the Hire Start Date or when subsequently asked during the Contract Period;

      6. You have breached any term of the Contract;

      7. You are subject to insolvency, and insolvency in the event that You are:

        1. a company is when:

          1. You are unable to pay Your debts or have no reasonable prospect of being able to pay them;

          2. You enter into liquidation;

          3. there is a passing of a resolution for a creditors winding up or any steps are taken in respect of obtaining a moratorium;

          4. You enter into a composition in satisfaction of Your debts or a scheme of arrangement with Your creditors;

          5. there is an application made for an administration order in respect of Your company;

          6. an administrator, receiver or administrative receiver is appointed to Your company; or

        2. a person is when:

          1. You are unable to pay Your debts or have no reasonable prospect of being able to pay them;

          2. You have a bankruptcy petition presented against You;

          3. You enter into a composition in satisfaction of Your debts or a scheme of arrangement of Your affairs; or

          4. You have a receiver or interim receiver appointed on Your behalf;

(referred to below as the "Contract Period").     


  1. You have a legal right to end the Contract and cancel Your booking within 14 days of the Contract Start Date. You can exercise this right by email to hello@pocket.storage. If You exercise this right, You will be given a refund based on the length of time that You have used the Unit for and You must remove any items You stored within the Unit within 24 hours.

  2. When the Contract ends, You must:

    1. remove any items You have brought into the Unit;

    2. return the Unit to a good state of repair and condition reflective of the condition it was in when on the Hire Start Date;

    3. no longer access the Unit, Common Areas and Premises (as defined in Clause 3a below).

If You fail to do so You may be charged a fee for cleaning and/or repairing the Unit. Any items which have not been removed may be removed and then sold or disposed of by Pocket Storage (on behalf of the Owner) or by the Owner directly. The Owner has the right to claim possession of the contents of the Unit and sell or otherwise dispose of the contents, retaining all sums achieved. The Owner may offset those sums received (minus all charges incurred by the Owner) against any sums due under the Contract to the Owner by You.


  1. You must pay any outstanding fees due including costs incurred in yielding-up the Unit in accordance with the terms of the Contract, administering the debt collection and/or sale process of any goods. If the proceeds of sale are insufficient to discharge all or any part of the sums owing by You to the Owner, You remain liable to pay all those outstanding costs.

  2. If the contents of the Unit cannot be sold for any reason whatsoever the Owner is authorised to treat them as abandoned goods and to destroy or otherwise dispose of them at Your cost.

  3. The Owner reserves the right to continue to charge You the fees applicable for the Unit until the contents of the Unit are sold or removed, any debt owing to the Owner is paid in full and the Unit is in a state of repair and condition required under the Contract.


3. USE OF THE UNIT AND THE COMMON AREA


  1. Your Contract will give You the right to access and use the self storage unit or units identified in Your booking details (referred to below as the “Unit”) to store items that are not Prohibited Goods (as defined in Clause 3p below) and to access the common areas such as parking spaces, lifts, and accessways that are identified as Pocket Storage common areas (referred to below as the "Common Areas") within the building in which the Unit is situated (referred to below as the “Premises”).

  2. The access and usage rights referred to in Clause 3a immediately above will be available to You:

    1. from the start date that You selected during the booking process (referred to below as the "Hire Start Date") until the date upon which Your Contract comes to an end in accordance with Clause 2 above or Clause 4b below; and

    2. subject to the access times applicable to the specific location of Your Unit as set out on the Pocket Storage website, Pocket Storage App and/or in Your booking details (noting that while some Premises offer 24/7 access, others may have restricted access hours). You must ensure that You comply with the specified access times for the location of Your Unit. Pocket Storage and the Owner will each use reasonable endeavours to notify You of any changes to the access times as soon as possible but these may be unavoidable (for example due to an emergency or a need to repair the Common Areas or the Premises) in which case You may not be entitled to a refund.   3. The access and usage rights granted by the Contract do not constitute a lease or a tenancy. Your Contract does not create a proprietary interest in the Unit of the Common Areas or the Premises or in any way create a relationship of landlord and tenant between You and the Owner or Pocket Storage.

  4. You will ensure that Your use of the Unit and the Common Areas complies with the requirements set out in the Terms and Conditions and You must not use the Unit or the Common Areas for any purpose or in a manner that is not permitted by these Terms and Conditions.

  5. You acknowledge that entry to the Premises and Common Area will be gained via the use of an access code individual to You that will be communicated to You by Pocket Storage. You will also be given a separate access code individual to You to access the Unit (collectively, the “Access Codes”). The Access Codes are changed frequently, are confidential and may under no circumstances be provided to or used by third parties. You must not change any Access Code or share them with any other person. In the event that You want to give another person access to the Unit, You must obtain a specific access code for that purpose, by contacting Pocket Storage via email at hello@pocket.storage or via the Pocket Storage App. Pocket Storage may refuse to allow a third party access if it considers such third party to be unsuitable (for example, known history of causing damage to property or being a nuisance). You are responsible for the third parties to whom additional access codes have been issued and if those third parties result in You breaching any of these terms that breach shall be deemed to be a breach by You. Should You or a third party for who You are responsible forget an Access Code a new code can be obtained by contacting Pocket Storage via email at hello@pocket.storage or via the Pocket Storage App.

  6. You will keep the Unit locked at all times when You are not present at the Unit and You will be responsible for the acts or omissions of anyone to whom You grant access to the Premises, the Unit and/or the Common Areas referred to in Clause 3a above.   

  7. You will notify Pocket Storage immediately on becoming aware of any theft of, or damage to, any items stored in the Unit.

  8. You will follow and comply with the requirements of all signage in place at the Premises as well as all instructions issued to You by Pocket Storage or by the Owner including in relation to security, recycling, waste disposal, pest control and energy saving.

  9. You will not access or seek to access any parts of the Premises which belong to any other owners and/or occupiers of the wider building.

  10. You shall keep the Unit clean at all times, and all recycling and refuse must be disposed of in the designated areas. You shall be liable to Pocket Storage and the Owner for any costs incurred by Pocket Storage or the Owner as a result of Your failure to dispose of recycling or refuse in accordance with these Terms and Conditions. Pocket Storage and the Owner will be entitled to treat any items left outside the Unit as rubbish and to dispose of them. You will be charged for (and be responsible for paying) any associated disposal costs.


  1. You may use the trolleys made available within the Common Areas. All trolleys must be returned to their designated bays and must not be removed from the Common Areas. You shall be liable for all replacement costs and any other damages suffered by Pocket Storage or the Owner if You remove any trolleys from the Premises or if You otherwise damage any trolleys.

  2. You will not attach anything to the interior or exterior of the Unit or to the Common Areas and You will not store anything within the Unit which could cause damage to the Unit or the Common Areas such as explosive or hazardous items. You will be responsible for any damage or destruction that You have caused to the Units or the Common Areas including any furnishings, equipment or fixtures. You must notify Pocket Storage and the Owner immediately in the event that You becomes aware of any damage or destruction to the Unit or the Common Areas. You must repair any damage You have caused to the Unit of the Common Areas, fair wear and tear excepted or You will be charged (and will be responsible for paying) the associated repair costs.

  3. You shall not use the Unit: (i) as a workplace; (ii) as residential accommodation; (iii) for any commercial activity; (iv) as a registered office or seat of a company; or (iv) for any illegal, criminal, tax evasive or immoral activities.

  4. You shall not: (i) connect any electrical appliances or other utilities / services in the Unit; or (ii) fix items or install items in or on the Unit, without the prior written consent of Pocket Storage (on behalf of the Owner) or the Owner directly. You shall switch off any authorized electrical appliances when You are not present at the Unit.

  5. You shall ensure that at all times the Unit is used in a way which does not cause damage to the environment and does not cause any nuisance (whether actionable or not), annoyance, inconvenience or disturbance to the Owner or any other customers or to any other occupiers of the Premises.

  6. You must not store any of the following “Prohibited Goods” at the Unit: jewellery, fur, art objects, collection pieces, irreplaceable objects, objects with emotional or special value, cash money, securities, stocks or shares, any item which emits any fumes, smells or odours; firearms, weapons, ammunition, explosives, chemicals, fertiliser or artificial fertiliser, radioactive materials, biological agents, toxic, flammable or hazardous waste, asbestos or processed asbestos, wet or damp items or any other material of a potentially dangerous nature; plants, birds, fish, animals, or any other living creatures; food, perishable goods, refuse or other water materials; any item likely to produce a noxious odour; gas bottles, compressed gases, batteries, combustible or any inflammable substances, including engines, diesel, petrol,  cars, motorcycles; or any article or thing which is or might become dangerous, offensive, combustible, inflammable, radioactive or explosive, anywhere within the Unit or on the Premises. All items stored must be items that You own or that You are otherwise authorised to store for the legal owner. No illegal goods or substances, goods illegally obtained or stolen property or items for which VAT has not been paid may be stored in the Unit. The Owner has the final decision on what may be stored (which may be communicated by Pockert Storage on behalf of the Owner). Any item that the Owner will not allow to be stored must be removed immediately. If You, after being informed to remove the item have not done so within 24 hours of notification Pocket Storage (on behalf of the Owner) or the Owner directly may remove or arrange removal of the said item(s) and dispose of them as appropriate. You will be charged for (and will be responsible for paying) the costs of this removal.


  1. Any Prohibited Goods that You bring onto the Premises or store within the Unit will be entirely at Your own risk and liability.


  1. You will be responsible for any damage to the Unit and/or Premises caused by storing any Prohibited Goods within the Unit. You will be charged for (and will be responsible for paying) the costs associated with any such damage.


  1. You will not bring animals onto the Premises or allow the same to enter the Common Areas and/or the Unit.

  2. You will share access to the Common Areas with other customers.

  3. You acknowledge that these are unmanned sites and as such if You have any queries You need to contact Pocket Storage by email on hello@pocket.storage or via the Pocket Storage App.


4. UNIT SIZE 


  1. During the booking process You selected the size and location of the Unit. You accept that all size indications set out on the Pocket Storage website and/or the Pocket Storage App are estimates and any deviation does not give You any entitlement to a price adjustment, refund or damages.

  2. If, after booking and/or upon accessing the Unit, You determine that the size of the Unit is not suitable for Your storage needs, Pocket Storage will use reasonable efforts to work with You to find a satisfactory solution. To initiate this process, You must notify Pocket Storage as soon as possible after discovering that the Unit is not suitable. Pocket Storage will endeavour to respond promptly and provide guidance on the available options.

  3. If for any reason the Unit isn’t available on the Hire Start Date, You may be offered a refund or an alternative unit at the same or a different location. If You are offered and accept a refund the Contract will come to an end on the date that the refund is given. If You are offered and accept an alternative unit, the terms of Your Contract will be deemed to be updated and You will receive an email which confirms the amendments to Your booking details. Subject to Clause 9a below, neither Pocket Storage nor the Owner will be liable to You for any loss that You may suffer as a result of any delay in the availability of the Unit.

  4. If during the Contract Period You would like to amend Your booking and switch to a smaller or a larger unit please contact Pocket Storage by email at hello@pocket.storage or via the Pocket Storage App. Any amendments will only be effective after Pocket Storage (on behalf of the Owner) or the Owner directly has confirmed availability and You have paid any additional charges due.  You will receive an email which confirms the amendments to Your booking details.

  5. Pocket Storage (on behalf of the Owner) may at any time by giving You at least 24 hours’ notice by email require You to move the contents of the Unit to another unit of the same or larger size.


5. POCKET STORAGE COMMITMENT


  1. Pocket Storage will ensure that the Common Areas are cleaned, maintained and secured in accordance with its commitments to the Owner. Pocket Storage shall exercise reasonable skill and care in providing such services.

  2. You acknowledge that CCTV is present and in operation at the Common Areas and at the Premises.


6. PAYMENT TERMS


  1. The weekly and monthly charges for the Unit were confirmed to You during the booking process and will be shown in the email confirming Your booking which is referred to in Clause 1b above. You must pay the charges (including any StoreProtect fees detailed during your booking process ("StoreProtect Charges") if you have selected "Goods Protection") as applicable for the rental duration that You selected during the booking process (weekly or monthly) for each full or partial week or month (as applicable) that falls during the period from the Hire Start Date to the end of the Contract Period. You must pay:

    1. the first weekly or monthly fee (as applicable) on the Contract Start Date; and

    2. for weekly rentals, the same day each week as the day of the Contract Start Date; and/or

    3. for monthly rentals, the same date each month as the date of the month of the Contract Start Date.

  2. Please note that the StoreProtect Charges may be included in the total amount payable for the Unit shown in Your booking details but they will be separately shown in the email confirming Your booking referred to in Clause 1b above.

  3. The payments in Clause 6a must be made by direct debit. You are responsible for updating Your direct debit instructions if required during the Contract Period. Any other payments that might become due under the Contract such as repair and/or cleaning costs will be set out in a notice to You and will be payable by You in accordance with the details set out in that notice.

  4. All amounts payable by You exclude value added tax ("VAT"), which You shall additionally be liable to pay at the prevailing rate.

  5. If You fail to make any payment due under Your Contract then:


  1. You will be charged interest on the overdue sum from the due date until payment of the overdue sum at a rate of 4% above the Bank of England's base rate from time to time or 4% for any period when that base rate is below 0%; and


  2. Pocket Storage (on behalf of the Owner) or the Owner directly may decide to appoint a debt collection agency and/or to pass the debt to a third party to recover payment from You.

You must inform Pocket Storage as soon as possible if there is a change in Your circumstances that may impact on Your ability to pay the fees due under this Contract or otherwise comply with the Terms and Conditions of the Contract.


7. CHANGES TO YOUR CONTRACT


  1. Rental fees: Pocket Storage (on behalf of the Owner) or the Owner directly may contact You to inform You of a proposed change to the weekly or monthly fee (as applicable) for the Unit from time to time. No changes to the fees due by You will be applicable unless agreed with You in writing.

  2. Wider changes: Pocket Storage (on behalf of the Owner) or the Owner directly may contact You to inform You of a change to these Terms and Conditions from time to time (for example a change required to ensure compliance with applicable law or the Owner's rights to use the Premises). Those changes will apply automatically unless You choose to end Your Contract in accordance with Clause 2b.


8. NOTICES

  1. All notices under the Contract from the Owner (or Pocket Storage on behalf of the Owner) will be sent to You writing by email to the address You gave us in the booking details or via the App unless You contact the Owner in accordance with Clause 3c to update Your contact details.   

  2. All notices under the Contract from You to the Owner must be sent via email to hello@pocket.storage or via the App.


9. INSURANCE AND LIABILITY


  1. Nothing in the Contract limits any liability which cannot legally be limited, including liability for:

    1. death or personal injury; or

    2. fraud or fraudulent misrepresentation.

  2. Subject to Clause 9.a and, if You have selected "Goods Protection" during your booking process, the StoreProtect Addendum, neither Pocket Storage nor the Owner shall be liable to You for any Loss or Damage to Your Property (as defined in the StoreProtect Addendum) in excess of £100 for any one event or series of connected events.

  3. You acknowledge and agree that you will be storing any goods in the Unit at Your own risk and You must arrange adequate protection or insurance for such goods. If You have not selected "Goods Protection" during your booking process (and You have not therefore entered into a StoreProtect policy), You will need to provide Pocket Storage with evidence of the insurance You have independently arranged prior to the Hire Start Date and during the Contract Period when requested to do so. That insurance must be equivalent to the greater of (i) the Maximum Replacement Value (as defined in the StoreProtect addendum below) or (ii) £2,500.

  4. Please note that Pocket Storage and/or the Owner will permit inspections or controls by the local, regulatory or criminal justice bodies or authorities in or on the Premises when requested to do so and will not inform You nor verify the rights of inspection. Subject to Condition 9.a neither Pocket Storage nor the Owner shall be liable for the consequences of any such inspection or control including (without limitation) any damage to Your goods or the Unit.

  5. If the Owner or Pocket Storage suffer a financial loss as result of You failing to comply with these Terms and Conditions, You may be liable for breaching Your Contract.

  6. Subject to Clause 9a, both Pocket Storage and the Owner exclude their liability to You for any indirect or consequential losses including lost bargain, lost profit, lost opportunity, loss of anticipated savings or lost reputation or for any damage as a result of the activities of other customers or the use of Premises.


10. TRANSFERRING RIGHTS UNDER THE CONTRACT


  1. You may not transfer, assign, sublet, share, charge or part with possession of the Contract or the Unit in whole or in part. The Contract shall be personal to You.

  2. The Owner may need to assign, transfer or charge its rights obligations or interest in the Unit, Premises or the Contract in whole or in part from time to time (for example due to a sale of the Premises). If this happens the Owner will notify You in writing.


  1. OWNER ACCESS


  1. Pocket Storage (on behalf of the Owner) or the Owner directly may access the Unit immediately in the event of an emergency or on 24 hours prior notice to You by email or via the App:

    1. to inspect the Unit or carry out repairs, maintenance and alterations to it or any other area of the Unit;

    2. if they reasonably believe that the Unit is being used in breach of any term of the Contract (for example to store Prohibited Goods);

    3. if they reasonably consider that such access is necessary to ascertain whether action needs to be taken to prevent injury or damage to persons or property;

    4. if they are required to do so by the police, customs, fire services, local authority or a court order; or,

    5. in accordance with the Owners rights at law or otherwise under the Contract.

  2. The Owner may undertake at any time any repairs, maintenance, development or improvement to the Premises and/or Common Areas and such works will not constitute a breach of the Contract by the Owner, even if such activities prevent or limit Your access to the Premises, Common Area and/or the Unit. The Owner shall be permitted to gain access to the Unit as part of any such works, however You shall not be entitled to any fee reduction.


12. HEALTH & SAFETY, SECURITY AND FIRE SAFETY

  1. You must follow all instructions given to You for Your safety, especially signs indicating entrance and exit routes. Speed and weight limits relevant to any Premises must be strictly adhered to (these will be communicated to You by Pocket Storage (that might be via the Pocket Storage website or via signage at the Premises) and as a guide the maximum weight limit for the lifts for most of the Properties will be 1500 kg). They can also be confirmed by contacting Pocket Storage at hello@pocket.storage). All doors and gates must be closed and secured, where applicable. You are liable for any associated costs, caused directly or indirectly, by gates or doors left un-secured by You. You must report any safety or security issues immediately to Pocket Storage.

  2. You are responsible for familiarizing Yourself with the emergency, safety and fire and escape routes (“Routes”) and procedures that are displayed at the Common Areas and Premises. Routes are situated throughout the Common Areas and Premises and are clearly marked. You agree not to block these Routes with goods or trolleys and must leave the Routes clear at all times. You may only use the Routes in the event of situations needing emergency evacuation such as fire or power loss. You will be liable for all costs incurred by the Owner or Pocket Storage for any misuse of the Routes or breach of the procedures.


13. GENERAL

  1. If You have any complaints please contact hello@pocket.storage.

  2. Where two or more customers are listed in the booking details, each of them is individually responsible for fulfilling the obligations under the Contract as well as being collectively responsible and each comes within the references to You in these Terms and Conditions.

  3. The Contract shall be governed by the laws of England and Wales and the courts of England and Wales shall have exclusive jurisdiction in respect of any and all disputes arising as a result of the Contract (be it contractual or otherwise).

You should read these Terms and Conditions carefully paying particular attention to Clauses 2c (fees that may apply if you fail to empty, clean and/or repair a Unit when your Contract ends), 2d (fees that may be due when yielding-up the Unit which may include debt collection fees and/or sale goods left behind), 2e (rights to sell abandoned goods), 3j (rights to remove and charge for refuse removal), 3k(cost for damage related to removal of or damage to trolleys), 3l (responsibility for damage and/or repair costs), 4b (request to change Unit size), 6c (repair and/or cleaning that might become due and 9 (liability limitations and exclusions). These Clauses have been specifically highlighted for Your attention because they contain provisions that may affect Your rights, obligations, or liabilities under this Contract.


1. COMMENCEMENT

Commencement

  1. Your Contract will come into force on the date that You click to accept the Terms and Conditions and pay the initial weekly or monthly (as applicable) charges outlined in the booking details on the Pocket Storage website or the Pocket Storage App (referred to below as the “Contract Start Date”).

  2. On or soon after the Contract Start Date You will receive an email which confirms Your booking details and contains a copy of these Terms and Conditions.


2. CONTRACT PERIOD AND YOUR RIGHTS TO BRING THE CONTRACT TO AN END


  1. Subject to Clause 2.b immediately below, Your Contract will continue until the end of the week or month (depending on which rental duration You selected during the booking process) that:

    1. You give 24 hours written notice to Pocket Storage of Your desire to end the Contract; or

    2. Pocket Storage (on behalf of the Owner) or the Owner directly gives You 24 hours written notice to end the Contract; or

    3. Pocket Storage (on behalf of the Owner) or the Owner gives You a written notice because:

      1. You have not paid the fees due in accordance with Clause 6;

      2. You have not set up a Direct Debit on or before the date of the Contract Start Date;

      3. You cancel a Direct Debit during the Term and following written notification by Pocket Storage (on behalf of the Owner) or the Owner ("Direct Debit Notice") You fail to reinstate the Direct Debit within a period of 7 days from the date of the Direct Debit Notice;

      4. You do not provide Your ID documentation required by the Owner before the Contract Start Date and at any point during the Term where reasonably required by the Owner;

      5. You have not selected "Goods Protection", You have not entered into a StoreProtect policy during Your booking process and You have not provided evidence of having sufficient, independently arranged, insurance in place (such insurance to be equivalent to the greater of (i) the Maximum Replacement Value (as defined in the StoreProtect addendum below) or (ii) £2,500) prior to the Hire Start Date or when subsequently asked during the Contract Period;

      6. You have breached any term of the Contract;

      7. You are subject to insolvency, and insolvency in the event that You are:

        1. a company is when:

          1. You are unable to pay Your debts or have no reasonable prospect of being able to pay them;

          2. You enter into liquidation;

          3. there is a passing of a resolution for a creditors winding up or any steps are taken in respect of obtaining a moratorium;

          4. You enter into a composition in satisfaction of Your debts or a scheme of arrangement with Your creditors;

          5. there is an application made for an administration order in respect of Your company;

          6. an administrator, receiver or administrative receiver is appointed to Your company; or

        2. a person is when:

          1. You are unable to pay Your debts or have no reasonable prospect of being able to pay them;

          2. You have a bankruptcy petition presented against You;

          3. You enter into a composition in satisfaction of Your debts or a scheme of arrangement of Your affairs; or

          4. You have a receiver or interim receiver appointed on Your behalf;

(referred to below as the "Contract Period").     


  1. You have a legal right to end the Contract and cancel Your booking within 14 days of the Contract Start Date. You can exercise this right by email to hello@pocket.storage. If You exercise this right, You will be given a refund based on the length of time that You have used the Unit for and You must remove any items You stored within the Unit within 24 hours.

  2. When the Contract ends, You must:

    1. remove any items You have brought into the Unit;

    2. return the Unit to a good state of repair and condition reflective of the condition it was in when on the Hire Start Date;

    3. no longer access the Unit, Common Areas and Premises (as defined in Clause 3a below).


If You fail to do so You may be charged a fee for cleaning and/or repairing the Unit. Any items which have not been removed may be removed and then sold or disposed of by Pocket Storage (on behalf of the Owner) or by the Owner directly. The Owner has the right to claim possession of the contents of the Unit and sell or otherwise dispose of the contents, retaining all sums achieved. The Owner may offset those sums received (minus all charges incurred by the Owner) against any sums due under the Contract to the Owner by You.


  1. You must pay any outstanding fees due including costs incurred in yielding-up the Unit in accordance with the terms of the Contract, administering the debt collection and/or sale process of any goods. If the proceeds of sale are insufficient to discharge all or any part of the sums owing by You to the Owner, You remain liable to pay all those outstanding costs.

  2. If the contents of the Unit cannot be sold for any reason whatsoever the Owner is authorised to treat them as abandoned goods and to destroy or otherwise dispose of them at Your cost.

  3. The Owner reserves the right to continue to charge You the fees applicable for the Unit until the contents of the Unit are sold or removed, any debt owing to the Owner is paid in full and the Unit is in a state of repair and condition required under the Contract.


3. USE OF THE UNIT AND THE COMMON AREA


  1. Your Contract will give You the right to access and use the self storage unit or units identified in Your booking details (referred to below as the “Unit”) to store items that are not Prohibited Goods (as defined in Clause 3p below) and to access the common areas such as parking spaces, lifts, and accessways that are identified as Pocket Storage common areas (referred to below as the "Common Areas") within the building in which the Unit is situated (referred to below as the “Premises”).

  2. The access and usage rights referred to in Clause 3a immediately above will be available to You:

    1. from the start date that You selected during the booking process (referred to below as the "Hire Start Date") until the date upon which Your Contract comes to an end in accordance with Clause 2 above or Clause 4b below; and

    2. subject to the access times applicable to the specific location of Your Unit as set out on the Pocket Storage website, Pocket Storage App and/or in Your booking details (noting that while some Premises offer 24/7 access, others may have restricted access hours). You must ensure that You comply with the specified access times for the location of Your Unit. Pocket Storage and the Owner will each use reasonable endeavours to notify You of any changes to the access times as soon as possible but these may be unavoidable (for example due to an emergency or a need to repair the Common Areas or the Premises) in which case You may not be entitled to a refund.   3. The access and usage rights granted by the Contract do not constitute a lease or a tenancy. Your Contract does not create a proprietary interest in the Unit of the Common Areas or the Premises or in any way create a relationship of landlord and tenant between You and the Owner or Pocket Storage.

  4. You will ensure that Your use of the Unit and the Common Areas complies with the requirements set out in the Terms and Conditions and You must not use the Unit or the Common Areas for any purpose or in a manner that is not permitted by these Terms and Conditions.

  5. You acknowledge that entry to the Premises and Common Area will be gained via the use of an access code individual to You that will be communicated to You by Pocket Storage. You will also be given a separate access code individual to You to access the Unit (collectively, the “Access Codes”). The Access Codes are changed frequently, are confidential and may under no circumstances be provided to or used by third parties. You must not change any Access Code or share them with any other person. In the event that You want to give another person access to the Unit, You must obtain a specific access code for that purpose, by contacting Pocket Storage via email at hello@pocket.storage or via the Pocket Storage App. Pocket Storage may refuse to allow a third party access if it considers such third party to be unsuitable (for example, known history of causing damage to property or being a nuisance). You are responsible for the third parties to whom additional access codes have been issued and if those third parties result in You breaching any of these terms that breach shall be deemed to be a breach by You. Should You or a third party for who You are responsible forget an Access Code a new code can be obtained by contacting Pocket Storage via email at hello@pocket.storage or via the Pocket Storage App.

  6. You will keep the Unit locked at all times when You are not present at the Unit and You will be responsible for the acts or omissions of anyone to whom You grant access to the Premises, the Unit and/or the Common Areas referred to in Clause 3a above.   

  7. You will notify Pocket Storage immediately on becoming aware of any theft of, or damage to, any items stored in the Unit.

  8. You will follow and comply with the requirements of all signage in place at the Premises as well as all instructions issued to You by Pocket Storage or by the Owner including in relation to security, recycling, waste disposal, pest control and energy saving.

  9. You will not access or seek to access any parts of the Premises which belong to any other owners and/or occupiers of the wider building.

  10. You shall keep the Unit clean at all times, and all recycling and refuse must be disposed of in the designated areas. You shall be liable to Pocket Storage and the Owner for any costs incurred by Pocket Storage or the Owner as a result of Your failure to dispose of recycling or refuse in accordance with these Terms and Conditions. Pocket Storage and the Owner will be entitled to treat any items left outside the Unit as rubbish and to dispose of them. You will be charged for (and be responsible for paying) any associated disposal costs.


  1. You may use the trolleys made available within the Common Areas. All trolleys must be returned to their designated bays and must not be removed from the Common Areas. You shall be liable for all replacement costs and any other damages suffered by Pocket Storage or the Owner if You remove any trolleys from the Premises or if You otherwise damage any trolleys.

  2. You will not attach anything to the interior or exterior of the Unit or to the Common Areas and You will not store anything within the Unit which could cause damage to the Unit or the Common Areas such as explosive or hazardous items. You will be responsible for any damage or destruction that You have caused to the Units or the Common Areas including any furnishings, equipment or fixtures. You must notify Pocket Storage and the Owner immediately in the event that You becomes aware of any damage or destruction to the Unit or the Common Areas. You must repair any damage You have caused to the Unit of the Common Areas, fair wear and tear excepted or You will be charged (and will be responsible for paying) the associated repair costs.

  3. You shall not use the Unit: (i) as a workplace; (ii) as residential accommodation; (iii) for any commercial activity; (iv) as a registered office or seat of a company; or (iv) for any illegal, criminal, tax evasive or immoral activities.

  4. You shall not: (i) connect any electrical appliances or other utilities / services in the Unit; or (ii) fix items or install items in or on the Unit, without the prior written consent of Pocket Storage (on behalf of the Owner) or the Owner directly. You shall switch off any authorized electrical appliances when You are not present at the Unit.

  5. You shall ensure that at all times the Unit is used in a way which does not cause damage to the environment and does not cause any nuisance (whether actionable or not), annoyance, inconvenience or disturbance to the Owner or any other customers or to any other occupiers of the Premises.

  6. You must not store any of the following “Prohibited Goods” at the Unit: jewellery, fur, art objects, collection pieces, irreplaceable objects, objects with emotional or special value, cash money, securities, stocks or shares, any item which emits any fumes, smells or odours; firearms, weapons, ammunition, explosives, chemicals, fertiliser or artificial fertiliser, radioactive materials, biological agents, toxic, flammable or hazardous waste, asbestos or processed asbestos, wet or damp items or any other material of a potentially dangerous nature; plants, birds, fish, animals, or any other living creatures; food, perishable goods, refuse or other water materials; any item likely to produce a noxious odour; gas bottles, compressed gases, batteries, combustible or any inflammable substances, including engines, diesel, petrol,  cars, motorcycles; or any article or thing which is or might become dangerous, offensive, combustible, inflammable, radioactive or explosive, anywhere within the Unit or on the Premises. All items stored must be items that You own or that You are otherwise authorised to store for the legal owner. No illegal goods or substances, goods illegally obtained or stolen property or items for which VAT has not been paid may be stored in the Unit. The Owner has the final decision on what may be stored (which may be communicated by Pockert Storage on behalf of the Owner). Any item that the Owner will not allow to be stored must be removed immediately. If You, after being informed to remove the item have not done so within 24 hours of notification Pocket Storage (on behalf of the Owner) or the Owner directly may remove or arrange removal of the said item(s) and dispose of them as appropriate. You will be charged for (and will be responsible for paying) the costs of this removal.


  1. Any Prohibited Goods that You bring onto the Premises or store within the Unit will be entirely at Your own risk and liability.


  1. You will be responsible for any damage to the Unit and/or Premises caused by storing any Prohibited Goods within the Unit. You will be charged for (and will be responsible for paying) the costs associated with any such damage.


  1. You will not bring animals onto the Premises or allow the same to enter the Common Areas and/or the Unit.

  2. You will share access to the Common Areas with other customers.

  3. You acknowledge that these are unmanned sites and as such if You have any queries You need to contact Pocket Storage by email on hello@pocket.storage or via the Pocket Storage App.


4. UNIT SIZE 


  1. During the booking process You selected the size and location of the Unit. You accept that all size indications set out on the Pocket Storage website and/or the Pocket Storage App are estimates and any deviation does not give You any entitlement to a price adjustment, refund or damages.

  2. If, after booking and/or upon accessing the Unit, You determine that the size of the Unit is not suitable for Your storage needs, Pocket Storage will use reasonable efforts to work with You to find a satisfactory solution. To initiate this process, You must notify Pocket Storage as soon as possible after discovering that the Unit is not suitable. Pocket Storage will endeavour to respond promptly and provide guidance on the available options.

  3. If for any reason the Unit isn’t available on the Hire Start Date, You may be offered a refund or an alternative unit at the same or a different location. If You are offered and accept a refund the Contract will come to an end on the date that the refund is given. If You are offered and accept an alternative unit, the terms of Your Contract will be deemed to be updated and You will receive an email which confirms the amendments to Your booking details. Subject to Clause 9a below, neither Pocket Storage nor the Owner will be liable to You for any loss that You may suffer as a result of any delay in the availability of the Unit.

  4. If during the Contract Period You would like to amend Your booking and switch to a smaller or a larger unit please contact Pocket Storage by email at hello@pocket.storage or via the Pocket Storage App. Any amendments will only be effective after Pocket Storage (on behalf of the Owner) or the Owner directly has confirmed availability and You have paid any additional charges due.  You will receive an email which confirms the amendments to Your booking details.

  5. Pocket Storage (on behalf of the Owner) may at any time by giving You at least 24 hours’ notice by email require You to move the contents of the Unit to another unit of the same or larger size.


5. POCKET STORAGE COMMITMENT


  1. Pocket Storage will ensure that the Common Areas are cleaned, maintained and secured in accordance with its commitments to the Owner. Pocket Storage shall exercise reasonable skill and care in providing such services.

  2. You acknowledge that CCTV is present and in operation at the Common Areas and at the Premises.


6. PAYMENT TERMS


  1. The weekly and monthly charges for the Unit were confirmed to You during the booking process and will be shown in the email confirming Your booking which is referred to in Clause 1b above. You must pay the charges (including any StoreProtect fees detailed during your booking process ("StoreProtect Charges") if you have selected "Goods Protection") as applicable for the rental duration that You selected during the booking process (weekly or monthly) for each full or partial week or month (as applicable) that falls during the period from the Hire Start Date to the end of the Contract Period. You must pay:

    1. the first weekly or monthly fee (as applicable) on the Contract Start Date; and

    2. for weekly rentals, the same day each week as the day of the Contract Start Date; and/or

    3. for monthly rentals, the same date each month as the date of the month of the Contract Start Date.

  2. Please note that the StoreProtect Charges may be included in the total amount payable for the Unit shown in Your booking details but they will be separately shown in the email confirming Your booking referred to in Clause 1b above.

  3. The payments in Clause 6a must be made by direct debit. You are responsible for updating Your direct debit instructions if required during the Contract Period. Any other payments that might become due under the Contract such as repair and/or cleaning costs will be set out in a notice to You and will be payable by You in accordance with the details set out in that notice.

  4. All amounts payable by You exclude value added tax ("VAT"), which You shall additionally be liable to pay at the prevailing rate.

  5. If You fail to make any payment due under Your Contract then:


  1. You will be charged interest on the overdue sum from the due date until payment of the overdue sum at a rate of 4% above the Bank of England's base rate from time to time or 4% for any period when that base rate is below 0%; and


  2. Pocket Storage (on behalf of the Owner) or the Owner directly may decide to appoint a debt collection agency and/or to pass the debt to a third party to recover payment from You.

You must inform Pocket Storage as soon as possible if there is a change in Your circumstances that may impact on Your ability to pay the fees due under this Contract or otherwise comply with the Terms and Conditions of the Contract.


7. CHANGES TO YOUR CONTRACT


  1. Rental fees: Pocket Storage (on behalf of the Owner) or the Owner directly may contact You to inform You of a proposed change to the weekly or monthly fee (as applicable) for the Unit from time to time. No changes to the fees due by You will be applicable unless agreed with You in writing.

  2. Wider changes: Pocket Storage (on behalf of the Owner) or the Owner directly may contact You to inform You of a change to these Terms and Conditions from time to time (for example a change required to ensure compliance with applicable law or the Owner's rights to use the Premises). Those changes will apply automatically unless You choose to end Your Contract in accordance with Clause 2b.


8. NOTICES

  1. All notices under the Contract from the Owner (or Pocket Storage on behalf of the Owner) will be sent to You writing by email to the address You gave us in the booking details or via the App unless You contact the Owner in accordance with Clause 3c to update Your contact details.   

  2. All notices under the Contract from You to the Owner must be sent via email to hello@pocket.storage or via the App.


9. INSURANCE AND LIABILITY


  1. Nothing in the Contract limits any liability which cannot legally be limited, including liability for:

    1. death or personal injury; or

    2. fraud or fraudulent misrepresentation.

  2. Subject to Clause 9.a and, if You have selected "Goods Protection" during your booking process, the StoreProtect Addendum, neither Pocket Storage nor the Owner shall be liable to You for any Loss or Damage to Your Property (as defined in the StoreProtect Addendum) in excess of £100 for any one event or series of connected events.

  3. You acknowledge and agree that you will be storing any goods in the Unit at Your own risk and You must arrange adequate protection or insurance for such goods. If You have not selected "Goods Protection" during your booking process (and You have not therefore entered into a StoreProtect policy), You will need to provide Pocket Storage with evidence of the insurance You have independently arranged prior to the Hire Start Date and during the Contract Period when requested to do so. That insurance must be equivalent to the greater of (i) the Maximum Replacement Value (as defined in the StoreProtect addendum below) or (ii) £2,500.

  4. Please note that Pocket Storage and/or the Owner will permit inspections or controls by the local, regulatory or criminal justice bodies or authorities in or on the Premises when requested to do so and will not inform You nor verify the rights of inspection. Subject to Condition 9.a neither Pocket Storage nor the Owner shall be liable for the consequences of any such inspection or control including (without limitation) any damage to Your goods or the Unit.

  5. If the Owner or Pocket Storage suffer a financial loss as result of You failing to comply with these Terms and Conditions, You may be liable for breaching Your Contract.

  6. Subject to Clause 9a, both Pocket Storage and the Owner exclude their liability to You for any indirect or consequential losses including lost bargain, lost profit, lost opportunity, loss of anticipated savings or lost reputation or for any damage as a result of the activities of other customers or the use of Premises.


10. TRANSFERRING RIGHTS UNDER THE CONTRACT


  1. You may not transfer, assign, sublet, share, charge or part with possession of the Contract or the Unit in whole or in part. The Contract shall be personal to You.

  2. The Owner may need to assign, transfer or charge its rights obligations or interest in the Unit, Premises or the Contract in whole or in part from time to time (for example due to a sale of the Premises). If this happens the Owner will notify You in writing.


  1. OWNER ACCESS


  1. Pocket Storage (on behalf of the Owner) or the Owner directly may access the Unit immediately in the event of an emergency or on 24 hours prior notice to You by email or via the App:

    1. to inspect the Unit or carry out repairs, maintenance and alterations to it or any other area of the Unit;

    2. if they reasonably believe that the Unit is being used in breach of any term of the Contract (for example to store Prohibited Goods);

    3. if they reasonably consider that such access is necessary to ascertain whether action needs to be taken to prevent injury or damage to persons or property;

    4. if they are required to do so by the police, customs, fire services, local authority or a court order; or,

    5. in accordance with the Owners rights at law or otherwise under the Contract.

  2. The Owner may undertake at any time any repairs, maintenance, development or improvement to the Premises and/or Common Areas and such works will not constitute a breach of the Contract by the Owner, even if such activities prevent or limit Your access to the Premises, Common Area and/or the Unit. The Owner shall be permitted to gain access to the Unit as part of any such works, however You shall not be entitled to any fee reduction.


12. HEALTH & SAFETY, SECURITY AND FIRE SAFETY

  1. You must follow all instructions given to You for Your safety, especially signs indicating entrance and exit routes. Speed and weight limits relevant to any Premises must be strictly adhered to (these will be communicated to You by Pocket Storage (that might be via the Pocket Storage website or via signage at the Premises) and as a guide the maximum weight limit for the lifts for most of the Properties will be 1500 kg). They can also be confirmed by contacting Pocket Storage at hello@pocket.storage). All doors and gates must be closed and secured, where applicable. You are liable for any associated costs, caused directly or indirectly, by gates or doors left un-secured by You. You must report any safety or security issues immediately to Pocket Storage.

  2. You are responsible for familiarizing Yourself with the emergency, safety and fire and escape routes (“Routes”) and procedures that are displayed at the Common Areas and Premises. Routes are situated throughout the Common Areas and Premises and are clearly marked. You agree not to block these Routes with goods or trolleys and must leave the Routes clear at all times. You may only use the Routes in the event of situations needing emergency evacuation such as fire or power loss. You will be liable for all costs incurred by the Owner or Pocket Storage for any misuse of the Routes or breach of the procedures.


13. GENERAL

  1. If You have any complaints please contact hello@pocket.storage.

  2. Where two or more customers are listed in the booking details, each of them is individually responsible for fulfilling the obligations under the Contract as well as being collectively responsible and each comes within the references to You in these Terms and Conditions.

  3. The Contract shall be governed by the laws of England and Wales and the courts of England and Wales shall have exclusive jurisdiction in respect of any and all disputes arising as a result of the Contract (be it contractual or otherwise).
